Basketball Hoops

  1. General Rules
    1. Hoops that are visible from the street or from the neighbors’ yards must be mechanically sound, clean, and well maintained. The net must always be intact.  Owners may not permit visible hoops to become an unsafe or unsightly nuisance.  The Board, in its sole judgment, may require the removal of such hoops. 
    2. For safety reasons and per the Community Rules & Regulations, hoops must not be positioned to encourage playing on a sidewalk, on neighbors’ property, or in a street.
      • Per the East Hempfield Township Spring/ Summer 2022 Newsletter, "Basketball Poles in Right-of-Way" - "If you have a freestanding basketball pole, place it in your driveway at a minimum of 3 feet away from the street.  These poles create a difficulty for the mailman, trash trucks, street sweepers, and leaf collection trucks.  Safety is a top priority for drivers, as well as township residents.  DO NOT permit your children to play in the street."
    3. Basketball hoops must be placed to avoid damage to vehicles, fragile plants, or other items on adjacent property. The unit owner is liable for any damage caused by a basketball goal; while in use/ operation or not. 
    4. The use of hoops must comply with East Hempfield Township’s sound ordinances. Hoops should not be used after dark or between 8:00 PM and 9:00 AM
  2. Modular Basketball Hoops
    1. Modular basketball hoops are hoops having a base with a capacity of at least 30 gallons filled with sand or water and a backboard that is clear and at least 48 inches wide. The base must be fully filled when the modular hoop is in use.  The placing of heavy materials on top of the base to improve stability is unsightly and not allowed.
    2. Modular hoops are not intended to be permanent or semi-permanent and should be stored out of sight of the street if not in weekly use.
    3. Modular hoops may be used only in the owner’s backyard or on the owner’s driveway and placed so that play does not extend onto neighbors’ properties, sidewalks, or streets. The presence of a sloping driveway does not waive or limit this restriction.  Hoops must not be used on or create on obstacle to use of common areas, sidewalks, or streets.  
    4. Modular hoops, like any other exterior change, are subject to advance written approval of the Executive Board. Please submit an ARC form before placing your modular hoop on your unit.  If you presently have a modular hoop in use, please submit an ARC form at your earliest convenience. 
  3. Permanent Basketball Hoops
    1. Permanent hoops mounted to a home or mounted on a pole that is secured by concrete footing or other permanent foundation are not permitted in the Community.
  4. Portable Basketball Hoops
    1. A portable basketball hoop is any goal that is not permanent or modular as described above.
    2. Portable hoops may be used as described in the general section, but may not be left in view of the street overnight. Portable hoops should be stored out of sight of the street and of neighbors any day when not in use.
    3. Portable hoops may be used only in the owner’s backyard or on the owner’s driveway and placed so that play does not extend onto neighbors’ properties, sidewalks, or streets. The presence of a sloping driveway does not waive or limit this restriction.  Hoops must not be used on or create on obstacle to use of common areas, sidewalks, or streets. 
    4. Portable hoops are not subject to approval of the Executive Board as they are to be stored out of sight when not in use.
