Overview:
To comply with the Landis Farm Unit Owners Association (“Association”) Declaration of Covenants & Restrictions (“Declaration”) and to provide consistent guidance for all Unit Owners, the following information is intended to provide guidance regarding fencing.
Restrictions:
- Per Declaration (Article IX Section 9.1.6), no Unit Owner or occupant shall be permitted to construct a fence anywhere within the Community without the prior consent of the Architectural Review Committee (“ARC”) (or the Executive Board, if applicable)
ARC Submission Guidance:
- All plans for the addition of fencing upon a Unit must be approved via the ARC submission process prior to installation.
- Fencing shall not extend closer to the street than the rear line of the dwelling.

- PLEASE NOTE: Dwellings within the community that have an exterior door located on the side which is forward from the rear line may request ARC approval to enclose that area with approved fencing (meeting all other guidelines.) In this scenario, the fencing shall not extend further towards the front line of the dwelling than is reasonably needed to enclose the side door. Also, any additional walkways to include a side door must also be included in an ARC submission.
- Maintenance of all fencing is the responsibility of the homeowner.
- Fencing must be installed a minimum of two (2) feet off the side and rear property lines except in the case of an easement where it shall not extend into the easement. The Unit Owner must verify all stormwater and utility easements prior to the fencing installation.
- In the case of corner properties, a fence shall project no more than eight (8) feet toward the street from the rear, street-facing corner of the home and shall be a minimum of two (2) feet from the edge of the sidewalk.
- Buried electronic wire fences for dog control shall be permitted provided its location is first approved via the ARC submission process prior to installation.
- Unit Owner is required to obtain all Township approvals.
Aesthetic Guidance:
- Fence height shall not exceed 48 inches.
- Approved Colors: Neutral color including but not limited to white, almond, clay and black.
- Approved Materials: Composite (vinyl) and Painted Metal.
- Fence style should be of an “open” design, not a solid or stockade type to maintain the open feeling of our community.

“Except as set forth in Section 9.1.8 below, no Unit Owner or occupant shall be permitted to construct a fence anywhere within the Community without the prior consent of the Architectural Review Committee (or the Executive Board, if applicable).”
- Article IX subsection 9.1.8, Restrictions, “Swimming Pools and Hot Tubs”:
“… The Owner of a Detached Unit may install a fence in connection with the installation of an in-ground swimming pool, provided that such fence (i) is not any higher than the minimum height required by the Municipality for fences attendant to an in-ground swimming pool; (ii) is set back at least two (2) feet from the Unit Title Lines; (iii) is not a chain-link, wire, net, stockade, solid panel or similar type fence; and (iv) may only extend from the rear corners of the Dwelling constructed on the Unit to and along the rear boundaries of Unit and no other portion of the Unit.”
